While the plaintiff argued that the waiver’s language was ambiguous and unenforceable, Mr. Cole’s defense effectively demonstrated the document’s clarity and purpose. Mr. Cole successfully argued to the court that the plaintiff’s own deposition testimony confirmed their comprehension of the agreement. The court ultimately ruled in favor of the defense, finding no genuine disputes that would allow a jury to invalidate the waiver.
